Urgent
Notice: Stoppages ordered not to proceed, bans still in
force

The CEPU has just
been ordered by Fair Work Australia to not proceed with
planned stoppages of work scheduled to start on Thursday (17
Dec), Friday (18 Dec), Monday (21 Dec).
It is understood
that FWA made the order after a Full Bench of the Tribunal
yesterday brought down an important decision in relation to
another employer about the way the law should be read when
thinking about how to formally notify companies about the
taking of industrial action.
Members are
therefore officially advised that the stoppage notices are
withdrawn and have no effect and should not be followed.
Having said that
it is important to remind members the following:

The CEPU
directs
members to
observe all
of the
following
bans
tomorrow,
Friday and
Monday:

Ban on the
performance
of revenue
checking and
collection
of postage
-
Ban on the
performance
of work that
stops
unstamped
mail/parcels
-
Ban on the
performance
of work that
complies
with
employer
policies
and/or
directions
relating to
attending
Facility
Nominated
Doctors
-
Ban on the
performance
of work
relating to
complying
with
employer
policies
and/or
directions
relating to
administrative
duties
-
Ban on the
performance
of work
relating to
complying
with
employer
policies
and/or
directions
relating to
the sign off
of paperwork
associated
with the
Resource
Optimisation
Model,
including
participating
in
consultation
processes
and data
collection
activities
associated
with the
process
-
Ban on the
performance
of work
relating to
complying
with
employer
policies
and/or
directions
concerning
the media
and
providing
information
to the
public
-
Ban on the
performance
of work
relating to
dress codes
-
Ban on the
performance
of work
relating to
not being
seated while
at work

Members would have
individually received
correspondence from Post
titled: "Partial Work Ban
Notice to Employees – Non
Payment." We draw your
attention to items no. 5 and
no.6 in Australia Post’s
notice to you:
"5. Because of the
Partial Work bans,
you will not be
entitled to any
payment for a day on
which you engage in
any of the above
Partial Work Bans
6. Australia Post
refuses to accept
the performance of
any work by you
until you are
prepared to perform
all of your normal
duties."
Taking Australia Post’s
direction into account, the
CEPU believes that members
who intend to apply ANY of
the bans notified, will not
be paid for the whole day
and will not be allowed to
work. We advise you to
recognise Australia Post’s
notice and acknowledge that
Post will not require you to
work in these circumstances.
